(Moody County, SD) — Joseph Hoek’s murder trial in Moody County is facing a delay as the defense requests a change of venue for a fair trial. Hoek, who’s charged with killing Chief Deputy Sheriff Ken Prorok in February of last year, appeared in court shackled Tuesday, with prosecutors calling multiple witnesses and playing a threatening voicemail from Hoek. The judge will review a community bias survey and decide on October 3rd whether to move the trial out of Moody County. Attorney General Marty Jackley says the state plans to seek the death penalty if Hoek is convicted.
