(Bismarck, ND) — North Dakota Attorney General Drew Wrigley is considering legal action against South Dakota regarding eminent domain law. He claims that a ban on eminent domain for carbon dioxide pipelines obstructs interstate commerce and, in turn, violates the commerce clause in the U.S. Constitution. South Dakota’s law, signed in March, prevents companies like Summit Carbon Solutions from forcing landowners to provide easements for a pipeline to transport carbon emissions to North Dakota for storage. South Dakota leaders, including Gov. Larry Rhoden and Rep. Jon Hansen, defend the law as protecting property rights. Wrigley called the ban a “hostile act” during an interview last week and stated that he would contact South Dakota leaders and Governor Kelly Armstrong about the issue.
