(Bismarck, ND) — Legal action against South Dakota’s eminent domain law for carbon dioxide pipelines is not possible now. That’s according to Attorney General Drew Wrigley, who said on a Fargo radio station in early September that a 2025 South Dakota law might violate interstate commerce and that he was considering legal action. Wrigley says the law blocks pipeline companies like Summit Carbon Solutions from using eminent domain to secure land easements. Summit plans a major CO2 pipeline through South Dakota but has been denied a route permit by the state.
