Lawyers Ask Judge To Toss Evidence In Daniel Breijo Case

(Minot, ND) — Lawyers for a man accused in a 2023 murder are saying that evidence in the case was obtained unlawfully. Attorneys for suspect Daniel Breijo say investigators seized his firearm and clothes during a nighttime search of his apartment with a daytime warrant and that the “good faith exception” should not apply. Breijo is accused of murdering Nicholas Van Pelt and injuring his girlfriend Jenni Babcock in December of 2023. The shooting took place at Breijo’s apartment. Judge Daniel El-Dweek is also considering if footage from an unaired documentary interview and Breijo’s blood alcohol levels can be used as evidence in the trial.
