(Devils Lake, ND) — A judge is vacating a murder conviction of Werner Kunkel who was serving life in prison. Attorneys believe it is the first murder conviction overturned in the history of the state. Judge Daniel Narum announced the decision on Friday, saying evidence was suppressed by prosecutors and the case was tainted by witnesses. Kunkel was found guilty in 1995 for the murder of Gilbert Fassett in 1986. Judge Narum ruled that four witness statements claimed they saw Fassett alive after the date prosecutors said he was killed, and the statements were withheld from the defense.
