South Dakota Supreme Court Denies Request To Change Birth Certificate Gender

(Sioux Falls, SD) — The South Dakota Supreme Court is denying a transgender woman’s request to change her birth certificate. Sigrid Nielsen filed a lawsuit to amend her birth certificate in September 2024. A lower court denied the request and it was appealed to the state Supreme Court. The Supreme Court ruled 5-0 against the appeal saying there are no state laws that would permit Nielsen to change the sex on the document. The court in its opinion also added that it is better to leave the definition of a man and woman to the state legislature.
