North Dakota Among States Calling On Supreme Court To Block EPA Ruling

(Bismarck, ND) — North Dakota is among several states asking the Supreme Court to block an EPA rule requiring large amounts of carbon capture at power plants in the next eight years. The rule requires any coal-fired plants planning to be open beyond 2038 to capture at least 90-percent of their carbon dioxide emissions by 2032, or shut down. The EPA argues the climate and health benefits of the rule substantially outweigh the cost, and will have little effect on electricity prices. The states are seeking a stay, claiming this milestone is not possible in that timeframe, and will force many plants to shut down, hurting both producers and customers.
