(Bismarck, ND) — A Bureau of Indian Affairs officer has been justified for using deadly force in a 2017 incident. The Eighth Circuit Court of Appeals affirmed an earlier U.S. District court ruling that officers were justified in using deadly force against George Gipp Junior. The man was shot and killed at a Fort Yates gas station roughly eight years ago after he reportedly resisted arrest and was seen with what authorities thought was a gun. One of the officers on scene fired their weapon and fatally wounded Gipp Junior. The court recently found the use of deadly force was reasonable given the circumstances leading up to its use.
