(Minot, ND) — A judge says he must review video footage of a murder suspect to determine if it’s admissible as evidence. The video is an unaired interview of Daniel Breijo. Breijo is accused of fatally shooting Air National Guardsman Nicholas Van Pelt and injuring his girlfriend at a Christmas Eve party in 2023. Prosecutors subpoenaed the video footage recorded by BEK TV, but BEK TV asked the judge to throw out the subpoena arguing they are protected by journalist shield laws. Both the prosecution and defense say the footage is important to the case.
