Judge Strikes Down North Dakota’s Carbon Dioxide Storage Law

(Bismarck, ND) — A state judge is ruling an underground carbon dioxide law as unconstitutional. The decision comes after a lawsuit by the Northwest Landowners Association against the State of North Dakota. They argue the law allows property to be taken without just compensation. The ruling threatens the Summit Carbon Solution’s pipeline project, which involves the building of a pipeline system that captures carbon dioxide from ethanol plants and transports it for safe use or storage. An appeal is expected to be submitted to the Supreme Court, while other legal challenges are pending.
