Supreme Court Hears Case Alleging Bidding Statute Violations

(Bismarck, ND) — The state Supreme Court is determining if the city of West Fargo violated bidding statutes. Two associations filed complaints in Cass County that accuse West Fargo of not properly advertising a project for a one-point-three million dollar mill and overlay street project. Some of the work for the project was advertised for bidding, but other portions were completed by city crews without a bidding procedure. The associations claim that the city doesn’t have the authority to “self-perform” public projects that cost more than 200-thousand dollars. The case was dismissed in county court because the work had already been completed.
