BNSF Railway Sues Cass County Farm for a Deadly Train Collision with a Combine

(Page, ND) — BNSF Railway is suing a group of Cass County farm owners and the estate of a man killed in a deadly train-combine crash near Page, asking for more than six-million-dollars in damages. The lawsuit names Kristopher and Kayla Satrom, William Lyle Satrom, and several farm owners, including Kris Satrom Farms and 4 B’s Seed Farm. BNSF is also suing the estate of Herman Van Den Berg, the combine driver who died in the crash, claiming he was negligent in failing to stop at the crossing and yield to the oncoming train. The crash happened in October of last year at a public railroad crossing on 133rd Avenue SE, about five miles northwest of Page. The impact caused the lead locomotive to catch fire. Three locomotives and 17 train cars derailed, and about 1,000 feet of track were damaged. The train’s engineer and conductor were not injured.
