State Lawmakers Consider Changes to How DUI Breath Tests are Listed on a Citation

(Bismarck, ND) — A DUI traffic stop involving the mayor of Lincoln has lawmakers looking at changing which breath test results should be listed on a citation. A Lincoln police officer pulled over Mayor Keli Jo Berglund in February for not having her rear lights on. The officer then suspected Berglund of drinking and driving. A roadside breath test registered at zero-point-zero-eight-seven percent, which is over the legal limit of zero-point-zero-eight percent. But when Berglund took a chemical breath test less than an hour later, it registered at a zero-point-zero-four-eight percent at the Burleigh Morton County Detention Center. Berglund pleaded guilty to a lesser charge of careless driving, but she worries about the preliminary breath test result or higher number that was put on her citation affecting her future and the future of others. She and State Representative Mike Berg are working on legislation to include both tests on driving records.
